Terms and Conditions for the Online Store

Version: 3.1
Date: October 7, 2026

1. Provider and Scope of Application

These Terms and Conditions apply to orders placed through the online store of

SAATKARY CARGO
Darius Alexander Saatkary
Sole Proprietorship
Bessemerstr. 82, 10th Floor South
12103 Berlin

– hereinafter “SAATKARY CARGO” – and its customers.

Customers can be either consumers or business owners.

A consumer is any natural person who enters into a legal transaction primarily for purposes that cannot be attributed to either their commercial or self-employed professional activities.

A business operator is a natural person, a legal entity, or a partnership with legal capacity that, at the time the contract is concluded, is acting in the course of its commercial or self-employed professional activities.

Any conflicting or supplementary General Terms and Conditions of the customer shall apply to business customers only if SAATKARY CARGO has expressly agreed to their validity.

2. Order, Inquiry, and Conclusion of Contract

2.1 Direct Order Through the Online Store

The presentation of the products that can be ordered directly from the online store constitutes a binding offer by SAATKARY CARGO to enter into a sales contract under the terms and conditions specified on the respective product page and during the ordering process.

The customer can first add the selected items to the shopping cart and review and correct their information before submitting the order.

By submitting an order requiring payment, the customer accepts the offer from SAATKARY CARGO . The purchase contract is concluded upon completion of the online ordering process.

The customer will then receive an electronic order confirmation. This confirms receipt of the order and the conclusion of the contract.

The method of payment selected generally has no effect on the time at which the contract is concluded. This also applies if payment is subsequently made by bank transfer or via a separately provided payment link.

2.2 Inquiries via JotForm, email, or other communication channels

In addition to placing orders directly through the online store, customers can submit non-binding inquiries—particularly for shipping containers and other goods that require extensive consultation or logistics—using the inquiry forms provided on the website (specifically JotForm), via email, or through other available communication channels.

Submitting such a request does not constitute an order or the conclusion of a sales contract.

SAATKARY CARGO Based on the inquiry, it can verify, in particular, availability, model, color, delivery location, storage facility, delivery terms, and shipping costs, and then provide the customer with a customized quote.

A contract based on such a request is not concluded until the customer accepts a binding offer sent by SAATKARY CARGO or the conclusion of the contract is otherwise expressly confirmed between the parties.

2.3 Availability and Self-Supply

Information regarding the availability of products is based on the inventory and shipping information available at the time.

SAATKARY CARGO sources certain goods, in particular shipping containers, in whole or in part from manufacturers, wholesalers, container depots, or other suppliers.

If an ordered item is unavailable after the contract has been concluded because SAATKARY CARGO , despite having entered into a procurement agreement in a timely manner and in accordance with the ordered item, does not receive delivery from its supplier through no fault of its own, SAATKARY CARGO is entitled to withdraw from the contract in accordance with the provisions of the law.

This applies only to the extent that SAATKARY CARGO is not itself responsible for the failure to deliver and the procurement transaction was concluded with due care.

SAATKARY CARGO In this case, the customer will be notified immediately of the unavailability. Any payments already received will be refunded immediately upon valid cancellation.

If only a specific color, style, size, or other variant is unavailable, SAATKARY CARGO may offer the customer an available alternative. Any change to the originally ordered merchandise will be made only with the customer’s consent.

If the item in question is a specific, customized item and its delivery has become impossible after the contract was concluded, the statutory provisions regarding impossibility of performance shall apply.

The statutory rights of both parties remain unaffected.

3. Language of the Contract and Contract Text

The German language is available for the conclusion of the contract.

Order information is stored as part of the order processing. After placing an order, the customer receives an electronic order confirmation containing the key order details. The customer can also use the link included in the order confirmation to view information about their order and its status.

The General Terms and Conditions can be accessed and saved via the SAATKARY CARGO website both before and after placing an order. SAATKARY CARGO does not provide the full text of the contract on a permanent basis beyond this.

4. Prices and Shipping Costs

The prices listed in the online store at the time of the order apply.

In addition to the price of the merchandise, shipping or delivery charges may apply. The applicable delivery charges will be communicated to the customer before the order is placed.

For certain bulky goods, particularly shipping containers, SAATKARY CARGO may offer a flat-rate delivery fee that includes agreed-upon unloading services. The delivery terms and delivery areas specified on the respective product page apply.

If no flat-rate delivery fee is offered for a particular delivery area, an individual agreement regarding delivery costs is required before placing an online order.

For inquiries regarding Section 2.2, the applicable shipping and transportation costs may be included in the individual quote.

5. Terms of Payment

Depending on the order, the available payment methods may be offered either directly during the online checkout process or after individual consultation.

The following payment methods, in particular, may be available during the online checkout process:

  • Credit card

  • PayPal and payment methods offered through PayPal

  • Apple Pay

  • Google Pay

  • Klarna, provided this payment method is offered for the order in question

In addition, the following payment methods, in particular, can be offered upon individual arrangement:

  • Prepayment or bank transfer

  • Payment via a SumUp payment link sent separately

These custom payment options do not need to be displayed in the online store's technical checkout process.

In the case of prepayment or bank transfer, the customer will receive the necessary payment information separately. As a general rule, the goods will not be shipped or released for delivery until full payment has been received.

If you pay through an external payment service provider, that provider's payment terms may also apply.

6. Delivery

Delivery is made exclusively via shipping.

Pickup is not available.

We do not offer delivery to package stations.

Available delivery areas and any delivery restrictions are displayed in the online store or during the ordering process.

For bulky goods, particularly shipping containers, delivery—including unloading—may be carried out using appropriate transport vehicles, such as a crane truck, provided that this is included in the respective quote.

Stated delivery times are considered binding delivery dates only if this has been expressly agreed upon.

With regard to the transfer of risk, the statutory provisions apply to consumers.

In transactions involving the sale by delivery, the risk of accidental loss and accidental deterioration passes to the seller upon delivery of the goods to the shipping agent, carrier, or any other person designated to carry out the shipment, to the extent permitted by law.

7. Damage During Shipping

Consumers are asked to report any obviously damaged packages to the delivery person at the time of delivery, if possible, and to notify SAATKARY CARGO .

Failure to provide such notification does not affect the consumer's statutory rights, in particular their warranty rights.

Business owners are subject to the statutory obligations to inspect and give notice of defects, in particular Section 377 of the German Commercial Code (HGB), provided that the conditions set forth therein are met.

8. Right of Withdrawal and Return Shipping Costs

Consumers generally have the statutory right of withdrawal, unless the law provides for an exclusion of that right.

The requirements, deadlines, exceptions, and consequences of cancellation are set forth in the separate cancellation policy available at SAATKARY CARGO.

In the event of a cancellation, the consumer is responsible for the direct costs of returning the goods, provided that the consumer was informed of this prior to the conclusion of the contract in accordance with legal requirements.

For goods that, due to their nature, cannot be returned by regular mail—in particular, shipping containers and similarly large or heavy goods—the direct costs of return are estimated at a maximum of approximately €3,000.

In the event of a valid statutory cancellation, the consumer will not be charged any fees or costs for processing the refund. In particular, any transaction or reversal fees incurred by SAATKARY CARGO in dealing with payment service providers will not be deducted from the consumer’s statutory right to a refund.

SAATKARY CARGO 's legal obligations to refund payments in the event of a valid cancellation remain unaffected.

For goods that are manufactured according to customer specifications or are clearly tailored to the consumer’s personal needs, the statutory right of withdrawal may be excluded in accordance with applicable law. The consumer will be expressly informed of such an exclusion prior to the conclusion of the contract.

Businesses are not granted a voluntary right of withdrawal.

9. Voluntary Cancellation and Termination of the Contract

Except for a statutory or expressly agreed right of revocation, withdrawal, or other right to terminate the contract, the customer has no general right to cancel an order after the contract has been concluded.

A request for cancellation by the customer therefore does not automatically result in the termination of the contract.

SAATKARY CARGO may voluntarily agree to an early termination of the contract requested by the customer.

In individual cases, such a voluntary termination of the contract may be contingent upon the customer actually covering costs that have already been incurred and can no longer be avoided or are non-refundable. This may include, in particular, payment processing fees that have actually been incurred and have not been refunded by the payment service provider.

Such costs are not charged to consumers on a flat-rate basis under these General Terms and Conditions. The nature and amount of the costs to be borne will be communicated to the consumer and agreed upon with him or her before a voluntary termination agreement is concluded.

The customer’s statutory rights of revocation, withdrawal, warranty, and other mandatory rights remain completely unaffected by this provision.

10. Retention of Title

The delivered goods remain the property of SAATKARY CARGO until the agreed purchase price has been paid in full.

SAATKARY CARGO also reserves title to goods sold to business customers until all claims arising from the respective ongoing business relationship have been paid in full, to the extent permitted by law.

11. Rights in Case of Defects and Warranties

11.1 Consumers

Consumers are entitled to the statutory rights regarding defects.

The statutory limitation period for claims for defects in new goods is generally two years from the date of delivery, unless otherwise provided by law.

An additional manufacturer's or retailer's warranty applies only if it is expressly offered for the specific product. Such a warranty does not limit your statutory rights regarding defects.

To the extent that a specific characteristic of a product is to deviate from the objective requirements for that product, the statutory requirements regarding separate disclosure and express agreement apply with respect to consumers.

11.2 Entrepreneurs

With respect to business customers, the statute of limitations for claims for defects in newly manufactured movable goods is, to the extent permitted by law, one year from the date of delivery.

In particular, this reduction does not apply to:

  • Damages resulting from injury to life, body, or health,

  • damages caused intentionally or through gross negligence,

  • defects that were fraudulently concealed,

  • expressly assumed guarantees,

  • Claims under the Product Liability Act or

  • Mandatory statutory rights of recourse.

If the customer is a merchant and the transaction constitutes a commercial transaction for both parties, the statutory obligations to inspect and give notice of defects under § 377 of the German Commercial Code (HGB) apply.

12. Special Provisions for Shipping Containers

12.1 One-Trip and First-Trip Containers

If a shipping container is described in the product description as “One-Trip,” “First Trip,” or with a similar condition designation, this refers to a container that is either newly manufactured or in like-new condition and that, due to standard manufacturing and import logistics, may have already completed its first transport journey from the manufacturing site to the sales market.

During this trip, as well as during transshipment, loading, and unloading, minor visible signs of transport and handling may occur. These may include, in particular, minor scratches, scuffs, paint wear, and minor dents.

Provided that such marks correspond to the “One-Trip” or “First-Trip” condition specified in the product description and, in particular, do not impair the container’s functionality, structural integrity, or expressly warranted characteristics, they comply with the agreed-upon condition class.

With respect to consumers, the statutory requirements for agreeing to a quality that deviates from objective standards remain unaffected.

12.2 Product Images, Labels, and Color

Product images may be for illustrative purposes only, unless a specific individual container is expressly being sold.

In particular, container numbers, manufacturer markings, stickers, labels, and similar markings may differ from those shown on the example.

Minor variations in color may occur due to production, age, or shipping. This does not affect any color that has been expressly confirmed or any other finish that has been expressly agreed upon.

12.3 Dimensions, Weights, Certifications, and CSC Label

Technical specifications regarding dimensions, weights, payloads, and volumes are generally based on the manufacturer’s or model-specific specifications. We reserve the right to apply minor tolerances that are customary for technical or manufacturer-related reasons, provided that such tolerances do not impair the agreed-upon use.

If a container is expressly advertised as ISO-certified or bearing a CSC sticker, this characteristic is part of the agreed-upon quality.

The specific validity of a CSC certificate, or the date of the next required inspection, if any, is determined by the markings on the respective container and the applicable regulations. Any subsequent required re-inspection or recertification is not part of the sales contract, unless expressly agreed upon.

12.4 Requirements for Delivery and Unloading by Crane

In the case of delivery by a crane truck or other specialized vehicle, the customer must ensure, prior to delivery, that the agreed-upon delivery and unloading location is safely accessible to the vehicle being used.

In particular, this includes the following:

  • the access road is sufficiently wide and suitable for the size and weight of the vehicle being used,

  • there are no unaccounted-for access, weight, or height restrictions,

  • there is sufficient space for maneuvering and parking,

  • the subfloor is sufficiently secure, stable, and as level as possible, and

  • there is sufficient open space for the agreed-upon crane unloading.

The customer must notify SAATKARY CARGO in a timely manner prior to delivery of any special local conditions or restrictions that may affect access, unloading, or installation.

The actual unloading is subject to the condition that it can be carried out safely from a technical standpoint. There is no entitlement to have the container set down at a location that cannot be safely reached by the vehicle or crane being used.

If delivery or unloading cannot be carried out, or cannot be carried out in full, for reasons attributable to the customer, the additional costs actually incurred as a result—in particular for waiting time, a fruitless trip, return transport, temporary storage, or a repeat trip—may be charged to the customer, provided that the legal requirements for doing so are met.

12.5 Installation Space and Permits

The customer is responsible for ensuring that the intended installation site is suitable, unless an inspection or consultation by SAATKARY CARGO has been expressly agreed upon.

This applies in particular to the load-bearing capacity and nature of the subgrade.

The customer is solely responsible for obtaining any required public or private law permits for the installation, use, or structural modification of a container, unless obtaining such permits has been expressly agreed upon as a service to be provided by SAATKARY CARGO .

The delivery of a container does not constitute a guarantee that its installation or intended use at a specific location is permitted under building codes or other public laws.

12.6 Changes Made by the Customer

If changes are made to the container after delivery—in particular, cutouts, welding, drilling, modifications, painting, or other technical alterations—the statutory rights regarding defects that already existed at the time of transfer of risk remain unaffected.

SAATKARY CARGO However, it is not liable for defects or damage caused by subsequent modifications made by the customer or a third party commissioned by the customer.

12.7 Special Provisions for Business Owners

To the extent that § 377 of the German Commercial Code (HGB) applies, contractors must inspect the delivered container immediately upon delivery and report any apparent defects in accordance with statutory requirements.

The container's condition class specified in the respective product description is decisive for assessing whether the container meets the contractual specifications.

Common optical marks that correspond to the expressly agreed “One-Trip,” “First-Trip,” or other condition class do not constitute a defect with respect to business customers, provided that no different quality specifications have been expressly agreed upon.

13. Liability

SAATKARY CARGO is liable without limitation for damages caused by willful misconduct or gross negligence.

SAATKARY CARGO . also bears unlimited liability for damages resulting from injury to life, body, or health; for expressly assumed warranties; and to the extent that mandatory statutory liability applies, in particular under the Product Liability Act.

In the event of a breach of a material contractual obligation due to slight negligence, liability is limited to the damages that were typically foreseeable at the time the contract was concluded.

Essential contractual obligations are those obligations whose fulfillment is essential to the proper performance of the contract and on whose fulfillment the customer may reasonably rely.

Furthermore, liability for damages caused by slight negligence is excluded to the extent permitted by law.

14. Consumer Mediation

SAATKARY CARGO is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

15. Governing Law

The laws of the Federal Republic of Germany apply.

With respect to consumers, this choice of law applies only to the extent that it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has his or her habitual residence.

German law applies to business transactions, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

16. Jurisdiction

If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction shall be Berlin—to the extent permitted by law.

Mandatory statutory venues for litigation remain unaffected.
